V letech 1993 až 2003 působil jako externí poradce Václava Havla, s nímž pak spolupracoval až do roku 2008, kdy přijal kandidaturu do senátu jako nezávislý senátor za Stranu zelených. O rok později byl jmenován ministrem pro lidská práva a národnostní menšiny a tento post zastával i na evropské úrovni během předsednictva České republiky v Evropské unii.
