What Climate Justice Means And Why We Should Care - Elizabeth Cripps
We owe it to our fellow humans – and other species – to save them from the catastrophic harm caused by climate change.Philosopher Elizabeth Cripps approaches climate justice not just as an abstract idea but as something that should motivate us all. Using clear reasoning and poignant examples, starting from irrefutable science and uncontroversial moral rules, she explores our obligations to each other and to the non-human world, unravels the legacy of colonialism and entrenched racism, and makes the case for immediate action. The second half of the book looks at solutions. Who should pay the bill for climate action? Who must have a say? How can we hold multinational companies, organisations – even nations – to account? Cripps argues powerfully that climate justice goes beyond political polarization. Climate activism is a moral duty, not a political choice.

Climate Justice - Cass R. Sunstein
The social cost of carbon: The most important number you''ve never heard of—and what it means. If you''re injuring someone, you should stop—and pay for the damage you''ve caused. Why, this book asks, does this simple proposition, generally accepted, not apply to climate change? In Climate Justice, a bracing challenge to status-quo thinking on the ethics of climate change, renowned author and legal scholar Cass Sunstein clearly frames what’s at stake and lays out the moral imperative: When it comes to climate change, everyone must be counted equally, regardless of when they live or where they live—which means that wealthy nations, which have disproportionately benefited from greenhouse gas emissions, are obliged to help future generations and people in poor nations that are particularly vulnerable. Invoking principles of corrective justice and distributive justice, Sunstein argues that rich countries should pay for the harms that they have caused and that all of us are obliged to take steps to protect future generations from serious climate-related damage. He shows how “choice engines,” informed by artificial intelligence, can enable people to save money and to reduce the harms they produce. The book casts new light on the “social cost of carbon,” the most important number ... Unknown localization key: "more"

Indigenous Peoples and International Trade
The United Nations Declaration on the Rights of Indigenous Peoples is seen primarily as an international human rights instrument. However, the Declaration also encompasses cultural, social and economic rights. Taken in the context of international trade and investment, the UN Declaration is a valuable tool to support economic self-determination of Indigenous peoples. This volume explores the emergence of Indigenous peoples'' participation in international trade and investment, as well as how it is shaping legal instruments in environment and trade, intellectual property and traditional knowledge. One theme that is explored is agency. From amicus interventions at the World Trade Organization to developing a future precedent for a ''Trade and Indigenous Peoples Chapter'', Indigenous peoples are asserting their right to patriciate in decision-making. The authors, both Indigenous and non-Indigenous experts on trade and investment legal, provide needed ideas and recommendations for governments, academia and policy thinkers to achieve economic reconciliation.

Human Rights and Schooling - Audrey Osler
Most of the struggles for equitable schooling, including multicultural curricula and culturally responsive teaching, have largely taken place on a local or national stage, with little awareness of how international human rights standards might support these struggles. Human Rights and Schooling explores the potential of human rights frameworks to support grassroots struggles for justice and examines the impact that human rights and child rights education can make in the lives of students, including the most marginalized. The author, Audrey Osler, examines the theory, research, and practice linking human rights to education in order to broaden the concept of citizenship and social studies education. Bringing scholarship and practice together, the text uses concrete examples to illustrate the links between principles and ideals and actual efforts to realize social justice in and through education. Osler anchors her examination of human rights in the U.N Convention on the Rights of the Child, as well as the U.N. Declaration on Human Rights Education and Training. Book Features: Supports teachers in their everyday struggles for social justice. Contributes to theory and practice in human rights education. Advocates for greater international solidarity and cooperation in multicultural education. Explores how the concept of child rights can strengthen ... Unknown localization key: "more"

Implementation of Rights for Crime Victims in Theory and Practice - Anupama Sharma
There are many different ways in which victimsÂ’ rights can be implemented. The implementation pattern may vary depending on the type of rights a jurisdiction offers and the purposes it seeks to achieve via these rights. However, there are a few basic aspects that remain common to the variation in the implementation patterns across jurisdictions. This book provides a theoretical and practical overview of such implementation patterns, their features and underlying differences. It presents theoretical models capturing the different types of implementations of victimsÂ’ rights and the purposes that they can achieve. The book also offers a framework comprising the essential aspects involved in implementation of rights such as drafting and presentation, their visibility and accessibility to victims, enforcement of rights in case of breach, and assessment and evaluation of rights to ensure constant monitoring and improvement in implementation. The framework is tested by a sample case study in New Delhi, India, which showcases how the framework can be molded and applied to assess the existing implementation of victimsÂ’ rights and the scope for reform. The book will be of interest to those working in the areas of criminal justice, criminal procedure, victimology and human rights.

Assisted Suicide and the European Convention on Human Rights - Stevie Martin
Locating assisted suicide within the broader medical end-of-life context and drawing on the empirical data available from the increasing number of permissive jurisdictions, this book provides a novel examination of the human rights implications of the prohibition on assisted suicide in England and Wales and beyond. Assisted suicide is a contentious topic and one which has been the subject of judicial and academic debate internationally. The central objective of the book is to approach the question of the ban’s compatibility with the European Convention on Human Rights afresh; freed from the constraints of the existing case law and its erroneous approach to the legal issues and selective reliance on empirical data. The book also examines the compatibility of the ban on assisted suicide with rights which have either been erroneously disregarded or not considered by either the domestic courts or the European Court of Human Rights. Having regard to human rights jurisprudence more broadly, including in the context of abortion, the research and analysis undertaken here demonstrates that the ban on assisted suicide violates the rights of a significant number of individuals to life, to freedom from torture or inhuman or degrading treatment and to private life. Such analysis does ... Unknown localization key: "more"

Marginalisation and Human Rights in Southeast Asia
This book analyses marginalisation and human rights in Southeast Asia and offers diverse approaches in understanding the nuances of marginalisation and human rights in the region.Throughout the region, a whole range of similarities and differences can be observed relating to the Southeast Asian experience of human rights violation, with each country maintaining particular aspects reflecting the variability of the use and abuse of political power. This book explores the distinct links between marginalisation and human rights for groups exposed to discrimination. It focuses on ethnic minorities, children, indigenous peoples, migrant workers, refugees, academics, and people with disabilities. This book highlights the disparities in attainment and opportunity of marginalised and minority groups in Southeast Asia to their rights. It examines how marginalisation is experienced, with case studies ranging from a regional approach to country context. Paying attention to how broader socio-economic and political structures affect different people’s access to, or denial of, their fundamental human rights and freedoms, the book argues that tackling human rights abuses remains a major hurdle for the countries in Southeast Asia.Providing a broader conceptual framework on marginalisation and human rights in Southeast Asia and a new assessment of these issues, this book will be of interest ... Human Rights and Populism - Jolyon Ford
For decades, framing an issue as a ‘human rights’ issue carried certain power and effect in politics and international relations, one that has been challenged by the recent rise of populist political forces. Ford explores the recent impact of populist politics on the universalist human rights project, in particular, how scholars have framed and responded to this challenge.Ford offers a provocation to the human rights movement. Rather than ‘what have populists done to human rights?’, it asks ‘how did we, the human rights movement, do this to ourselves?’ How did fundamental protections for all become so easily scapegoated as ‘us and them,’ as claims of small, often foreign, minorities? Did human rights lose some vital connection to ordinary people’s interests, their value taken as obvious and self-explanatory?Looking forward, the book asks how – in a post-truth ‘fake news’ world – we might reimagine human rights as underpinning human flourishing as well as important constraints on public and private concentrations of power. Traversing relevant scholarly literature on the future of human rights and zooming out to look at wider patterns of political and diplomatic discourse, this book will speak to policymakers, diplomats, journalists, and human rights advocates – and all interested ... Online Courts and the Future of Justice - Richard Susskind
Our court system is struggling. It is too costly to deliver justice for all but the few, too slow to satisfy those who can access it. Yet the values implicit in disputes being resolved in person, and in public, are fundamental to how we have imagined the fair resolution of disputes for centuries. Could justice be delivered online? The idea has excited and appalled in equal measure, promising to bring justice to all, threatening to strike at the heart of what we mean by justice. With online courts now moving from idea to reality, we are looking at the most fundamental change to our justice system for centuries, but the public understanding of and debate about the revolution is only just beginning. In Online Courts and the Future of Justice Richard Susskind, a pioneer of rethinking law for the digital age, confronts the challenges facing our legal system and the potential for technology to bring much needed change. Drawing on years of experience leading the discussion on conceiving and delivering online justice, Susskind here charts and develops the public debate.Against a background of austerity politics and cuts to legal aid, the public case for online courts has too often been framed ... Child Protection and the European Court of Human Rights
Article 1 of the European Convention of Human Rights gives children the same protection of their fundamental rights and freedoms as adults. However, there is a notable absence of specific provisions for their rights. What does this imply in practice? This interdisciplinary volume brings together leading scholars in political science, law, social work and more to examine how the European Court of Human Rights (ECtHR) shapes – and is shaped by – child protection litigation and mobilisation. Norway has had more child protection cases decided by the ECtHR than any other country, and so this book, a first of its kind, uses Norway as a specific focus and explores the evolving role of the Court in balancing parental rights, state authority and children’s best interests, offering a fresh perspective on the intersection of international human rights law, children’s rights and child protection policy.

Can Human Rights and National Sovereignty Coexist?
Looking at two of the key paradigms of the post-Cold War era–national sovereignty, and human rights – this book examines the possibilities for their reconciliation from a global perspective. The real or imagined fear of a flood of immigrants has caused and fuelled the surge of an amalgam of populist political forces, anti-immigrant movements, and exclusionist nationalism in many developed countries. In the last decade, we have witnessed the emergence of two phenomena in the political and legal spheres. On the one hand, there are liberal globalists asking for respect and the protection of the basic human rights of migrants and asylum seekers and arguing for their civic and social integration into host societies. On the other hand, there are growing calls for a tougher stance on immigration, and powerful populist politicians and governments have emerged in many developed countries. How can the idea of universal human rights survive exclusionist nationalism that uses a populist, unscrupulous approach to its advantage? The contributors to this book explore the meaning of, and possible solutions to, this dilemma using a wide range of approaches and seek appropriate ways of dealing with these normative predicaments shared by many developed societies. Abortion and Reproductive Justice - Loretta J. Ross, Marlene Gerber Fried
"Required reading for anyone dedicated to bodily autonomy and sovereignty now and into the future."—Ms. MagazineA bold call to action and guide for building an inclusive and intersectional reproductive justice movement.  Overturning Roe unleashed a wave of urgent threats to abortion and bodily autonomy, fueled by overt white supremacy, racial and anti-immigrant hatred, and support for traditional gender roles and sexual identities. But the resistance is fierce, led by a new generation of activists of color dedicated to building an inclusive movement. In Abortion and Reproductive Justice, widely recognized movement leaders Marlene Gerber Fried and Loretta J. This critical approach—originating in Black feminism—provides grounding for radical abortion advocacy. Geophysical and Climate Hazards - Bill McGuire
Very Short Introductions: Brilliant, Sharp, InspiringIn this Very Short Introduction Bill McGuire takes a fresh look at our sometimes perilous planet, and evaluates the causes and consequences of what used to be thought of as ''natural'' hazards through the prism of planetary heating and the continuing destabilising of our climate. Our world has always been a dangerous and deadly place, and storms, floods, earthquakes, tsunamis and volcanic blasts have taken an enormous toll on lives and livelihoods throughout recorded history and before. In the past, such events were regarded first as acts of God, or gods, and later as simply a consequence of hazardous natural phenomena that are a normal part of how our planet works. In recent decades, however, this picture has changed. Relentless global heating, arising from the 2.4 trillion tonnes of carbon dioxide pumped into the atmosphere as a result of human activities, has completely altered the ''natural'' hazard landscape. There has long been a debate about whether - due to the influence of societal and economic factors - there is such a thing as a truly natural disaster. State, Peasants, and Land in Mid-Nineteenth-Century Egypt - Dr. Maha A. Ghalwash
An alternative reading of the relationship between the state and smallholder peasants in mid-nineteenth-century EgyptThis book examines the rural history of Egypt during the middle years of the nineteenth century, a period that is often glossed over, or altogether forgotten. Drawing on a wide array of archival sources, some only rarely utilized by other scholars, it argues that state policy targeting the peasant land tenure regime was informed by the dual economic principles of the Ottoman, or traditional, philosophy of statecraft, and that the workings of the relevant regulations did not produce extensive peasant land loss and impoverishment.Maha Ghalwash presents a rich, detailed analysis of such crucial issues as land legislation, tax impositions, the system of tax collection, modes of land acquisition, large-scale peasant abandonment of land, the emergence of surplus lands, the formation of large, privileged estates, distribution of village land, female land inheritance, and the nature of peasants’ political activity. In investigating these issues, she highlights peasant voices, experiences, and agential power.Traditional interpretations of the rural history of nineteenth-century Egypt generally specify an avaricious state, so indifferent to peasant well-being that it consistently developed harsh policies that led to unremitting, extensive peasant impoverishment. Gender, Violence and Criminal Justice in the Colonial Pacific - Katerina Stevens
Centering on cases of sexual violence, this open access book illuminates the contested introduction of British and French colonial criminal justice in the Pacific Islands during the late 19th and early 20th centuries, focusing on Fiji, New Caledonia, and Vanuatu/New Hebrides. It foregrounds the experiences of Indigenous Islanders and indentured laborers in the colonial court system, a space in which marginalized voices entered the historical record.Rape and sexual assault trials reveal how hierarchies of race, gender and status all shaped the practice of colonial law in the courtroom and the gendered experiences of colonialism. Trials provided a space where men and women narrated their own story and at times challenged the operation of colonial law. Through these cases, Gender, Violence and Criminal Justice in the Colonial Pacific highlights the extent to which colonial bureaucracies engaged with and affected private lives, as well as the varied ways in which individuals and communities responded to such intrusions and themselves reshaped legal practices and institutions in the Pacific. With bureaucratic institutions unable to deal with the complex realities of colonial lives, Stevens reveals how the courtroom often became a theatrical space in which authority was performed, deliberately obscuring the more complex and violent practices ... Instead, it argues for just-driven education and introduces an integrated justice framework encompassing environmental, epistemic, transitional and social justice. The authors reveal how connecting education to local contexts empowers young people to critically engage with justice and drive systemic reform, offering a visionary blueprint for sustainable development worldwide.

New York Times BestsellerNow part of the HBO docuseries "Exterminate All the Brutes," written and directed by Raoul PeckRecipient of the American Book AwardThe first history of the United States told from the perspective of indigenous peoples  Today in the United States, there are more than five hundred federally recognized Indigenous nations comprising nearly three million people, descendants of the fifteen million Native people who once inhabited this land. The centuries-long genocidal program of the US settler-colonial regimen has largely been omitted from history. Now, for the first time, acclaimed historian and activist Roxanne Dunbar-Ortiz offers a history of the United States told from the perspective of Indigenous peoples and reveals how Native Americans, for centuries, actively resisted expansion of the US empire. With growing support for movements such as the campaign to abolish Columbus Day and replace it with Indigenous Peoples’ Day and the Dakota Access Pipeline protest led by the Standing Rock Sioux Tribe, An Indigenous Peoples’ History of the United States is an essential resource providing historical threads that are crucial for understanding the present. In An Indigenous Peoples’ History of the United States, Dunbar-Ortiz adroitly challenges the founding myth of the United States and shows how ... Unknown localization key: "more"

Wrongs and Rights Come Apart - Nicolas Cornell
It is common to regard rights and wrongs as mirror images: to be wronged is to have one’s rights violated. Nicolas Cornell rejects this view. Drawing on diverse real-world examples, he argues that rights determine how we ought to shape our interpersonal conduct, while wrongs alone tell us what corrective action is appropriate after a violation.

Sea and Land - John R. McNeill, Stuart B. Schwartz, Philip D. Morgan, Matthew Mulcahy
Sea and Land provides an in-depth environmental history of the Caribbean to ca 1850, with a coda that takes the story into the modern era. It explores the mixing, movement, and displacement of peoples and the parallel ecological mixing of animals, plants, microbes from Africa, Europe, elsewhere in the Americas, and as far away as Asia. It examines first the arrival of Native American to the region and the environmental transformations that followed. It then turns to the even more dramatic changes that accompanied the arrival of Europeans and Africans in the fifteenth century. Throughout it argues that the constant arrival, dispersal, and mingling of new plants and animals gave rise to a creole ecology. Particular attention is given to the emergence of Black slavery, sugarcane, and the plantation system, an unholy trinity that thoroughly transformed the region''s demographic and physical landscapes and made the Caribbean a vital site in the creation of the modern western world. Increased attention to issues concerning natural resources, conservation, epidemiology, and climate have now made the environment and ecology of the Caribbean a central historical concern. Sea and Land is an effort to integrate that research in a new general environmental history of the ... Unknown localization key: "more"

Sentencing and Criminal Justice - Andrew, QC Ashworth, Rory Kelly
This revised and updated new edition focuses on major developments in sentencing law, practice and theory. Sentencing in England and Wales is now dominated by Sentencing Council guidelines, and scrutiny of those guidelines is central to this book. Issues of principle are identified and discussed, to include the constitutional position of the Sentencing Council; the meaning of, and challenges to, proportionality; and the sentencing of BAME offenders and women offenders. The book welcomes the new Sentencing Code, introduced as the Sentencing Act 2020, and critically examines the government’s plans for sentencing reform, set out in the 2020 White Paper A Smarter Approach to Sentencing. Throughout the book, sentencing is explored in its wider criminal justice context – making it essential reading for courses on sentencing, criminal justice and criminal law.

Urban Gardening and the Struggle for Social and Spatial Justice
The book presents an in-depth and theoretically-grounded analysis of urban gardening practices (re)emerging worldwide as new forms of bottom-up socio-political participation. By complementing the scholarly perspectives through posing real cases, it focuses on how these practices are able to address – together with environmental and planning questions – the most fundamental issues of spatial justice, social cohesion, inclusiveness, social innovations and equity in cities. Through a critical exploration of international case studies, this collection investigates whether, and how, gardeners are willing and able to contrast urban spatial arrangements that produce peculiar forms of social organisation and structures for inclusion and exclusion, by considering pervasive inequalities in the access to space, natural resources and services, as well as considerable disparities in living conditions. This book is relevant to United Nations Sustainable Development Goal 16, Peace, justice and strong institutions

Abortion Services and Reproductive Justice in Rural South Africa - Catriona Ida Macleod, Ulandi du Plessis
Accessing abortion services in rural areas under conditions of liberal abortion legislation is neither straightforward nor simple. As the South African example shows, the liberalisation of abortion legislation was the first step in granting pregnant persons access to abortion care. Despite this and some progress in implementation, many challenges persist resulting in a lack of services, especially in areas where distances and transport costs are a factor. Drawing on the findings of a study conducted in three rural districts of the Eastern Cape, the authors highlight the complexities involved in understanding problematic or unwanted pregnancies and abortion services within these communities; the reported barriers to, and facilitators of, access to abortion services among rural populations; and preferences for types of abortion services. A key finding is the conundrum of costs versus confidentiality: lack of confidentiality involves additional costs to access services outside the area; high costs mean that confidentiality may have to be foregone, which leads to stigma. The authors place the findings within a reparative reproductive justice framework and present a comprehensive set of recommendations. Abortion Services and Reproductive Justice in Rural South Africa is an insightful and informative resource – the first of its kind – for scholars ... Unknown localization key: "more"

Monotheism and Social Justice - Robert Karl Gnuse
The rise of monotheistic religious faith in ancient Israel and post-exilic Judaism inspired the imperative for social justice on behalf of the poor and the oppressed. Though some authors have maintained that monotheism inspires tyranny, this author maintains that real monotheistic faith affirms justice and human equality.

Transgender Rights vs Women's Rights - Robert Wintemute
“Trans rights are human rights!â€Â “Women’s rights are human rights!â€Â Yes, but the human rights of two groups often conflict. The only way to resolve these conflicts is through calm, rational, public debate. Freedom of expression protects the right of women to question certain demands by trans rights activists, even if this might offend. Raising conflicts between transgender rights and women’s rights is not “transphobicâ€, because disagreement is not hatred. The concept of “transphobia†should be defined narrowly as statements or acts indicating hostility or prejudice towards transgender persons. If the right to speak about conflicts is protected, and we start by acknowledging the broad areas of agreement about the human rights of transgender people, we can turn to the substance of these conflicts. Should it be possible for an individual to change their legal sex? If so, how easy should it be? Should it be changeable only after a diagnosis of gender dysphoria and a waiting period? Or should it be sufficient to “self-identify†as a person of the opposite sex? Or should sex be removed from birth certificates, so that there is nothing to change? Robert Wintemute carefully examines these conflicts, considers the differences between transgender rights and ... Women's Rights and Global Socialism: Volume 30, Part 1
Women''s emancipation was a central but contested pillar of socialist and communist internationalism during the twentieth century. The collapse of state socialism has led to renewed interest in the history and legacies of women''s movements across the former socialist world during the era of decolonisation, and their significance for global feminisms in the present day. Responding to these debates, this collection of essays explores the history of transnational socialist feminisms during the global Cold War from the perspective of mid-ranking activists, officials and functionaries in international communist and left-revolutionary movements in Eastern Europe and the postcolonial world. Drawing on new sources, including private correspondence, interviews, memoirs and institutional archives, the essays ask how these activists defined women''s rights from the era of the Popular Fronts in the 1930s until the United Nations Decade of Women (1976–1985).
