The aim of the textbook is to provide students with a guide to the basic theoretical questions of law. It is up to legal theory to reveal common principles and traditions beyond local particularisms. A bridge should be built between the study of positive law and the study of legal theory. Too often these fields are studied separately as if opposed to each other. But practice without theory is blind while theory without practice is useless.The author has devoted separate chapters to the important topics – nature of law, major legal systems, sources of law, legal relations, legal liability, interpretation of law, law and morality, law and justice.The textbook is intended primarily for foreign students which attend courses of legal theory at the law schools in the Czech Republic. Osobitnou spoločnou východoeurópskou skúsenosťou sú potom v 20. storočí rozsiahle zásahy do vlastníckych pomerov (pozemkové reformy, konfiškácie, znárodnenia), prudké štátoprávne premeny a viacnásobné zmeny hraníc v tejto časti Európy, či napokon doteraz badateľný vplyv sovietskych právnych vzorov. Jedinečnou je v tejto súvislosti tiež právna skúsenosť s opakovanými spoločenskými prechodmi medzi totalitou a demokraciou, v recentnom období spojená, navyše, s výzvami europeizácie a globalizácie práva. Všetky uvedené jedinečné skúsenosti spájajú štáty stredovýchodnej Európy a ovplyvňujú ich príbuznú právnu identitu a kultúru, často dostatočne nepochopenú mimo tohto regiónu. Nepochopenie a neznalosť je však tiež dôsledkom nedostatočnej prezentácie spoločných právnohistorických tradícií stredovýchodnej Európy na celoeurópskom fóre. Práve uvedený nedostatok sa snaží odstrániť predstavovaná monografia, ktorá je v záujme širšieho dosahu napísaná v anglickom jazyku.

JUDr. Klára Alžběta Samková, Ph.D., born in 1963 in Brno into a family of art historians. She graduated from the Law Faculty in Brno and Prague, furthermore studied at London´s College of Law. She has undertaken a number of study visits abroad mainly focusing on the defence of human rights including time spent in the Canadian Parliament and with the Canadian Commission for Human Rights as well as in the USA Congress in the office of Congressman Christopher Cox. In 1990 she was elected as a member of the Federal Parliament (of the then Czechoslovakia) and there for the length of her two-year mandate worked in the Constitutional and Legal Affairs Committee. In 2003 President Václav Klaus nominated her to become a judge of the Constitutional Court but the Senate rejected her nomination on the grounds of her supposed ´immaturity´. Since 1994 has managed her own law office in Prague which only employs women lawyers. In the public arena she continuously expresses her opinions in relation to legal matters and politics in general. Vznik nové formy buddhismu v rámci tradiční burjatské sanghy lze datovat do poloviny 20. století. Po druhé světové válce se v rámci tzv. první obnovy náboženství objevilo úsilí zachránit z represáliemi sužovaného tibetského buddhismu alespoň základní věci. Ve třicátých letech byly kláštery pobořeny, některé zcela zničeny, mniši vyhnáni, někteří popraveni, část z duchovenstva byla zavřená do gulagu a zbytek se musel vzdát mnišského stavu. V polovině šedesátých let, v období prvních kritik Stalinova kultu vznikla v Ulan-Ude malá, ale významná skupina, buddhistická komunita. Neoficiální, tajná mikro-sangha se formovala pod vedením B. B. Dandarona, burjatského buddhisty a buddhologa a existovala až do jeho uvěznění v roce 1972. Byl odsouzen na pět let nucených prací a ve věku šedesáti let v roce 1947 v pracovním táboře umírá. Jeden z jeho nejpřednějších žáků A. I. Železnov namaloval thangku, věnovanou svému učiteli; jednalo se o mandalu Vadžrabhajravy. Namaloval ji jako inovaci starobylé tradice a thangka tak představuje unikátní zobrazení v rámci burjatské buddhistické tradice, neboť začleňuje i prvky z vnějšího světa. Je až překvapivé jak mnoho lze z thangky vyčíst s využitím religionistického přístupu. Tato metodologie se odlišuje od způsobu, jak obrazu rozumí sami vyznavači rodícího se Dandaronova kultu.
