Ak sa svedok pri plnení tejto povinnosti vystavuje vážnemu nebezpečenstvu, potom sa podľa princípov právneho štátu vyžaduje jeho účinná ochrana.Vznik inštitucionálnej ochrany svedka sa datuje do 70. rokov minulého storočia v Spojených štátoch amerických, kde bola prvýkrát použitá ako právny inštitút na rozloženie zločineckých organizácií štýlu Mafie. Až do deväťdesiatych rokov dvadsiateho storočia sa v našich podmienkach ochrana svedka nejavila tak aktuálnym problémom, ako tomu bolo v západných krajinách, v ktorých už v tom čase bol organizovaný zločin rozvinutý. V podmienkach Slovenskej republiky sa právna úprava ochrany svedka začala zásadnejšie meniť od 90. rokov minulého storočia v súvislosti so zmenami v spoločnosti. Inštitucionálna ochrana svedka bola do právneho poriadku Slovenskej republiky zavedená prijatím zákona č. 256/1998 Z. z. o ochrane svedka s účinnosťou od 1. januára 1999. Uvedený zákon vytvoril podmienky na poskytovanie ochrany a pomoci osobe vypovedajúcej ako ohrozený svedok alebo chránený svedok, prípadne poskytujúcej dôkazy s cieľom odhalenia a usvedčenia páchateľov predovšetkým organizovanej trestnej činnosti. V súvislosti s prijímaním uvedeného zákona boli novelizované aj ďalšie súvisiace predpisy. Policajnému zboru sa zverila úloha zabezpečovať ochranu chráneným svedkom a medzi hlavné úlohy Policajného zboru sa zaviedla úloha poskytovať ochranu a pomoc ohrozenému svedkovi a chránenému svedkovi podľa osobitného predpisu.Komentár k zákonu o ochrane svedka predstavuje výklad príslušných ustanovení zákona v širších súvislostiach. Pri štruktúre hesla bolo zvolené osvedčené členenie komentovaného zákona. Po uvedení dikcie zákona sú uvedené súvisiace ustanovenia zákona o ochrane svedka, ďalej súvisiace ustanovenia iných právnych predpisov, potom nasleduje text komentára k ustanoveniu a na záver je uvedená relevantná judikatúra k danému ustanoveniu. Cieľom nebolo a ani nemohlo byť podrobne predstaviť metódy a formy poskytovania ochrany a pomoci ohrozenému a chránenému svedkovi. Uvedené metódy, postupy a formy sú upravené internými predpismi ministerstva vnútra a tvoria utajované skutočnosti podľa zákona č. 215/2004 Z. z. o ochrane utajovaných skutočností a o zmene a doplnení niektorých zákonov.
