The story of "natural law" - the idea that God has written a law on the human heart so that ethical norms derive from human nature - in twentieth-century Protestant ethics is one of rejection and resurgence. For half a century, luminaries like Karl Barth, Carl F. H. Henry, and Cornelius Van Til cast a shadow over natural law moral reflection because of its putative link to natural theology, autonomous reason, associations with Catholic theology, and ethical witness devoid of special revelation. However, over the past twenty years, Protestant theologians have renewed their interest in the subject, often animated by debates on Christian involvement in the public arena and on matters of life, death, and gender and sexuality. Much of this engagement has happened within Reformed circles and has largely been conducted without reference to Roman Catholic construals of the natural law. The resort to extensive quotations should provide the reader with first hand resources without the (always subjective) deformation of the respective source via paraphrasing. This textbook is not intended to serve as an all-encompassing textbook or encyclopedia. After all, for that it would be too short in the first place. The objective here is to provide the reader with a basic introduction into the key areas of public international law, foundations upon which one can built further study. The reason is that this book is primarily intended as a main textbook for a one semester course called Introduction to Public International Law taught at the University of West Bohemia in Pilsen and frequented primarily by Erasmus exchange students for whom English is in most cases a foreign language. To Holmes'' way of thinking, this approach is superior to imposing order in accordance with a philosophical position or theory because the law would thereby lose the flexibility it requires in responding to the needs and demands of disputing parties as well as society as a whole.According to Holmes, the social environment--the economic, moral, and political milieu--alters over time. Therefore, in order to remain responsive to this social environment, the law must change as well. But the law is also part of this environment and impacts it. There is, then, a continual reciprocity between the law and the social arrangements in which it is contextualized. And, as with the evolution of species, there is no starting over. Rather, in most cases, a judge takes existing legal concepts and principles, as these have been memorialized in legal precedent, and adapts them, often unconsciously, to fit the requirements of a particular case and present social conditions. Oliver Wendell Holmes, Jr. (1841-1935) served as chief justice of the Massachusetts Supreme Court and as an associate justice of the U.S. Supreme Court.
