Medzinárodná zmluva ako nástroj vonkajšej činnosti Európskej únie je vedeckou monografiou, ktorá prináša analýzu úpravy medzinárodnej zmluvy v práve EÚ. The book analyzes traditional form of responsibility applicable in proceedings before the international criminal courts and tribunals according to which commander/superior is held responsible for failure to prevent or repress crimes under international law committed by his/her subordinates.In chronological order, the book addresses controversial origins of this doctrine and relevant case-law adopted until recently before the ad hoc tribunals, the International Criminal Court and some hybrid tribunals (mostly the ECCC). The book focuses both on material and procedural aspects of the doctrine. The procedural aspects are analyzed in relation to legal framework applicable before the ICC. The book elaborates on closely watched Regulation 55 which permits change in legal characterization of facts to accord with crimes in the subject-matter jurisdiction of the Court, or with the form of responsibility envisaged in the Statute. The book explores the consistency of this rule with statutory provisions concerning prosecutorial independence and the accused person's right to fair trial and contributes to better understanding between different forms of responsibility (Article 25 and Article 28 of the ICC Statute) and different subcategories of the superior responsibility itself.Finally, the book addresses various standards of proof envisaged in the text of the Rome Statute. Predkladaná publikácia sumarizuje rozhodovaciu prax slovenských súdov predovšetkým v otázkach zodpovednosti advokáta za škodu spôsobenú v súvislosti s výkonom advokácie (1. časť), teda za škodu spôsobenú klientovi advokáta, ktorý je s ním v zmluvnom vzťahu (§ 26 zákona č. 586/2003 Z. z. o advokácii).Osobitným problémom je zodpovednosť advokáta za škodu v iných prípadoch, t. j. vo vzťahu k bývalému klientovi alebo tretej osobe. Rozhodnutia k tejto téme sú zhromaždené v 2. časti. Vychádzajú z toho, že zodpovednosť advokáta v týchto prípadoch sa riadi všeobecnou úpravou zodpovednostných vzťahov (§ 415, § 420 Občianskeho zákonníka). Hoci postupom času sa judikatúra k téme zodpovednosti advokáta za škodu vykryštalizovala, rôznorodosť skutkových situácií, ktorú prináša prax, necháva viaceré otázky do budúcnosti otvorené. Práve táto rôznorodosť skutkových situácií vyvolala potrebu spracovať rozhodnutia zaradené do tejto publikácie tak, že bol daný pomerne široký priestor popisu skutkového stavu rozhodovaných vecí a citácií úvah, ktoré súdy viedli k rozhodnutiu, hoci samotná právna veta je v prípade rozhodnutí obdobná. Zodpovednosť za škodu v pracovnoprávnych vzťahoch je špecifickým vzťahom medzi zamestnávateľom a zamestnancom, ktorý vzniká ako dôsledok narušenia majetkovej alebo osobnej sféry zamestnanca alebo majetkovej sféry zamestnávateľa. Rozsudky, uznesenia a stanoviská súdov, týkajúce sa zodpovednosti za škodu v pracovnoprávnych vzťahoch, majú nezastupiteľné miesto v právnej praxi, a to najmä z dôvodu rozmanitosti situácií, ktoré môžu založiť vznik zodpovednosti za škodu zamestnávateľa a zamestnanca. Skutkové okolnosti, ktoré môžeme označiť za právne relevantnú škodovú udalosť, sú často nejednoznačné, resp. umožňujú rôzny výklad, a práve judikatúra napomáha určiť, či došlo k naplneniu predpokladov zakladajúcich nárok na náhradu škody v tej-ktorej situácii. Zbierka judikatúry vo veciach zodpovednosti za škodu v pracovnoprávnych vzťahoch predstavuje prvý komplexný súhrn judikatúry slovenských a českých súdov v období do 31. decembra 2015. Autori usporiadali zozbierané rozhodnutia v súlade so systematikou členenia zodpovednosti za škodu v Zákonníku práce, čím ponúkajú čitateľom prehľadnú a ucelenú zbierku. Vzhľadom na existujúce rozdiely medzi pracovnoprávnou úpravou Slovenskej a Českej republiky, ako aj na legislatívny vývoj a historické zmeny jednotlivých ustanovení Zákonníka práce, autori zjednodušili čitateľom orientáciu v judikátoch prostredníctvom odkazov na ustanovenia slovenského Zákonníka práce platného ku dňu vydania zbierky.
